We provide wide-ranging policy and legislative assistance to WIPO member states, upon request from national authorities.

This assistance draws on substantive expert knowledge and best practices, and can help policy makers tailorintellectual property (IP) legislation to their specific national context and policy needs.

We organize meetings and seminars aimed at raising awareness in crucial policy areas and legislative options for national or regional IP laws. These events can also provide an opportunity to gather feedback from relevant stakeholders regarding, for example, existing laws or on-going policy reforms.

Tailor-made consultations can take place virtually, at WIPO HQ in Geneva, or in one of WIPO member states. The aim is to bring government officials and IP experts at WIPO together to work on key policy topics.

Legislative advice

Legislative advice is provided in the areas of copyright, patents, trademarks, industrial designs, geographical indications, genetic resources, traditional knowledge and traditional cultural expressions,utility models, layout designs of integrated circuits, trade secrets andIP enforcement at the request of a member state or a regional intergovernmental organization. This advice is consistent with international legal obligations and tailored to specific needs and level of socio-economic development of the requesting party.

It is strictly bilateral and confidential and may involve assistance for:

  • the revision or update of an existing law or regulation in its entirety or in part;
  • the drafting of a new law or regulation;
  • the ratification or accession process for becoming a member of an existing treaty;
  • the implementation and enforcement of a new law, regulation or treaty (including assistance in informing relevant stakeholders);
  • national compliance with international treaty obligations or with negotiated bilateral or regional agreements; and
  • the implementation of flexibilities contained in the international treaties.

Flexibilities

We can advise our member states on how best to implement the various flexibilities that exist in international treaties. Taking account of specific national development needs and public policy environments, we assist in identifying IP strategies that can be adopted to support public policies in a way that is consistent with international obligations.
